These terms describe the Own The Bid service in plain language. They apply to this website and to anyone who books a call or buys the service.
Who we are
Own The Bid is operated by Joseph Gomez, a sole proprietor based in Los Angeles, California. In these terms, "we" and "us" mean Joseph Gomez operating as Own The Bid.
What this page is
This page is a summary, written so it is easy to read. It is not the full contract. The terms that legally bind us and a client are set out in the signed service agreement. If anything on this page conflicts with a signed service agreement, the signed service agreement controls.
The service
Own The Bid sells one offer, the Bundle: two systems delivered together.
- The Lead Machine: a lead generation system built on an all-in-one lead platform, in the client's name on the client's domain. Includes paid-advertising setup, site, CRM, calendar, email follow-up, and push notifications. No SMS. The build takes 14 days, with the first ad live by day 14. "Live" means the Meta campaign is in Active status, at least one ad set is approved, and impressions have begun serving.
- The Callback System: an AI voice agent and SMS layer that sits on top of a lead system (the Lead Machine, or a client's pre-existing CRM). Inbound web leads receive an AI voice callback within 5 minutes. The AI identifies itself as AI, captures the lead's name, number, email, and request, can send an SMS, and writes a summary to the client's CRM. Optional, per-client configurable features include qualifying questions, calendar booking, and call recording; each is off unless the client turns it on. The AI never quotes price, commits scope, or closes; the contractor does that on the callback. The setup takes about 14 to 21 days for the AI build and launch walkthrough, plus 2 to 8 weeks for A2P 10DLC carrier registration approval.
Each product is one done-for-you spec. There is no menu and no DIY version sold by us. A client can run either system themselves at any time after cancellation, or hire a different operator.
What the service does not include: we do not sell jobs, guarantee close rates, or take responsibility for the client's sales process after the lead lands.
What it costs
One offer, one flat monthly price. The Bundle (the Lead Machine and the Callback System together) is the only offer. There is no build fee and no setup fee.
- The Bundle: a flat $1,800 per month. This covers building the whole system and running it every month. There is no separate build or setup fee.
- Minimum term: a two-month minimum commitment, then month to month.
- Ad spend: a separate cost paid directly to Meta on the client's card, described below.
Prices shown on this website are the published prices on the date shown above and may change. The price for any client is the price set in that client's signed service agreement. Price changes apply only to clients who sign after the change date. Existing signed agreements are not repriced mid-term.
The founding-client rate lock. There is no founding discount. Every client pays the same published price. Clients who sign during the founding period lock their monthly rate for the life of the engagement: if the published standard rate rises later, the founding client keeps paying their signing-date rate. This is a rate lock, not a discount.
Case-study rights. Each founding client grants Own The Bid the right to use anonymized performance data and, on request, one named case study within the first 12 months of the system going live.
Billing and cancellation
Getting started. There is no build fee and no setup fee. The only amount due to start is the first half of the first month, $900, due when the service agreement is signed. It secures the client's spot and starts the 14-day build. The second half of the first month, $900, is due when the lead system goes live, no later than day 14 from signing. Delays caused by the client failing to provide required information or access (named in the onboarding checklist delivered at signing) do not move that launch target.
Is the $900 refundable? The $900 paid at signing is the first half of the first month, earned as work is performed. If the client cancels before any build work has begun, it is fully refundable. Once build work has begun, we keep only the documented work actually performed and the costs actually incurred, and refund the rest. We send an itemized record of the work and costs, and the refund of the remainder, within ten business days of the cancellation notice. There is no fixed forfeiture and no minimum amount kept. The full terms are in the signed service agreement.
The Callback System text layer. The AI build and launch walkthrough happen in roughly 14 to 21 days from signing. The full text layer goes live only once A2P 10DLC registration is approved, which is carrier-controlled and can take 2 to 8 weeks, so the text layer can land later than the build walkthrough (see below). There is no separate setup fee for this; it is part of the flat monthly.
The flat monthly fee is billed monthly in advance. The first month is split as described above ($900 at signing, $900 at launch); from the second month it is billed in full at the start of each billing month. There is a two-month minimum commitment. After the two-month minimum, the service is month to month: the client can cancel at any time, effective at the end of the current billing month, with no annual contract required. If a monthly payment fails, the service is paused on the third day after the failure. Time paused does not count toward the 45-day rebuild guarantee window.
Ad spend
Ad spend is the money paid to the advertising platform to run the advertising. It is a separate cost from the flat monthly fee. The client pays the advertising platform directly, on the client's own card and the client's own ad account. We never hold, front, or take a cut of ad spend.
Minimum ad spend for the Lead Machine's 45-day rebuild guarantee: the guarantee below applies only when the client commits to a minimum of $3,000 per month in paid ad spend, held across the 45-day guarantee window. The reason is mechanical, not commercial. Below that level, the Meta advertising platform cannot gather enough data to optimize the campaign, and the lead system will produce unstable results for reasons no rebuild can fix. A client may run the lead system on less than $3,000 per month, but the guarantee does not apply at lower spend levels.
What the Lead Machine build delivers
The build is included in the flat monthly fee; there is no separate build fee. It delivers, in the client's name and on the client's domain, by day 14:
- The tracked Meta ad account (including spend history, audience data, and tracking infrastructure as they accrue)
- The site (three pages: landing, qualify, thank-you) on the client's own domain
- The CRM where every lead, call, and message is tracked
- The business phone number, with call forwarding to the contractor's preferred line
- The auto-email reply that responds to homeowners within five minutes of submission
- The 60-day follow-up sequence (email only; SMS is part of the Callback System)
- The Google Business Profile setup
Plus the following, wired in during the build:
- Push-notification routing to the contractor's phone the moment a lead lands
- Booking link wired to a scheduling tool (Calendly or equivalent) for site visit booking
- Automatic Google review request that fires after every completed job the client marks complete in the CRM
- Two written ads (copy + creative) loaded and approved
- One launch walkthrough call so the client knows what they own and how it works
What the Callback System build delivers
The Callback System build, also included in the flat monthly fee with no separate setup fee, delivers:
- An AI voice agent (built on our voice platform) configured for the client's services, scripted to identify itself as AI and capture the lead's name, number, callback number, email, and request, with optional qualifying questions (budget, project type, timeline, decision-maker) the client can turn on
- Hallucination guardrails: the AI never quotes price or scope. All pricing or scope questions pivot to "let me have [Contractor] confirm that on the in-home walkthrough"
- A2P 10DLC brand and campaign registration filed with The Campaign Registry as the client's authorized agent. The client is the legal Brand under the client's EIN; we do not register under our EIN
- TCPA-compliant opt-in language hardened on the lead form authorizing AI-generated voice and SMS
- The AI states in its opening line that it is an AI assistant. Call recording is an optional, off-by-default feature; where the client enables it, the call discloses recording before any audio is captured, and a lead who declines is not recorded (California Penal Code 632 / 632.7, all-party consent)
- Caller ID warming protocol (no more than 50 calls per day for the first two weeks to prevent carrier spam-flagging)
- Workflow wiring connecting the lead form → AI call trigger → SMS to homeowner → captured details and summary written back to the contractor's CRM
You own everything
The items above are created in the client's name, on the client's card, and on the client's domain. We are given operator access to run the systems. We do not own these items.
No lead retention by us. We do not export, copy, store, or share lead data outside the client's own CRM and Meta ad account. Leads submitted via the lead system route directly to the client's CRM and the client's business phone. We do not receive, retain, resell, repackage, share, or route client leads, audience data, contact information, or call transcripts to any third party for any purpose.
Asset transfer on termination. If the client cancels, the client keeps every item above, every contact, every running campaign, every dollar of accumulated audience and tracking data, the Google Business Profile, the AI agent configuration (if Callback was purchased), and the A2P 10DLC brand registration (which is in the client's name). We remove our operator access within five business days of cancellation. The client is responsible for rotating passwords and reviewing administrative access on each account after handover. CRM contact data is exportable by the client at any time before, during, or after the engagement.
What stays ours. Our internal tools, templates, processes, ad-management methodology, AI prompts, RAG corpus structures, and operator playbooks remain ours. What is created in the client's name (the items above) is the client's. The signed service agreement spells this out in full.
What the flat monthly covers (the lead system)
The flat monthly fee covers, for the lead system, each month:
- Running the paid ad campaigns inside the client's ad account, including producing the ad creative (images and AI-generated video)
- Shipping at least one new ad variant (new image, new video, or substantially new copy) every 14 days
- Keeping the client's Google Business Profile current
- A personalized KPI dashboard plus a weekly written note in the client's CRM or shared channel summarizing lead volume, cost per lead, and any flagged quality issues
- Tuning the follow-up sequence as the offer or market shifts
- Triggering the Google review request after every job the client marks complete in the CRM
- Maintaining the auto-email reply, the booking link, and the push-notification routing
- Monitoring the live system during business hours (Monday-Friday, 9am-6pm Pacific) and acknowledging critical alerts (ad account disabled, billing failure, broken auto-reply) within one business day
The auto-email reply SLA. The auto-email reply is configured to fire within five minutes of an inbound lead being captured in the CRM. The five-minute window is measured from the CRM timestamp.
What the flat monthly does not cover: running the client's social media accounts (we can hand the client ad creatives to self-post, but we do not manage their socials), landing page rewrites, offer redesigns, live-action creative shoots, sales training, phone-call lead qualification beyond the Callback System, work outside the Meta paid-advertising lead system, or any service expansion not in the signed service agreement. (Phone-based qualifying is a Callback System feature, off by default; where it is off, the contractor qualifies on the callback. The AI never closes.)
What the flat monthly covers (the Callback System)
The flat monthly fee also covers, for the Callback System, each month:
- AI voice agent runtime and uptime monitoring during business hours
- 360 voice minutes included each month; usage beyond that is billed at cost, at our voice carrier's then-current published per-minute rate plus payment processing (currently $0.15 per minute), with no markup, capped at $200 per month with auto-pause that requires the client's written authorization to continue
- SMS to homeowners sent through the A2P-registered campaign (pass-through SMS carrier fees included up to 400 messages per month; messages beyond that are billed at carrier cost, no markup)
- The lead's captured details and a call summary written back to the client's CRM (a full transcript when recording is enabled)
- Weekly spot-check of 3 random call summaries for hallucination drift or script accuracy
- Ongoing tuning of the AI script and RAG grounding as the client's services or market shift
- Monthly A2P 10DLC compliance and throughput review
- Maintaining caller ID reputation. Where the voice vendor and the carrier support it, this includes monitoring STIR/SHAKEN attestation (STIR/SHAKEN is the phone-network system that labels a call as verified so it is less likely to show as "spam likely"). We do not control how a carrier assigns attestation, and we do not promise a specific attestation level. [UNCERTAIN: vendor capability not confirmed in repo]
Callback System SLAs. The AI agent attempts the first outbound call within five minutes of an inbound lead being captured. If the homeowner does not answer, the agent retries up to three times over four hours. The AI captures the lead's name, number, email, and request and writes a summary to the CRM. Qualifying, calendar booking, and recording are optional configured features, off unless the client enables them. The AI never quotes price, commits scope, or closes; the contractor calls the lead back.
AI behavior is probabilistic. The hallucination guardrails (no price quotes, no scope commitments) are configured via system prompt and RAG constraints. We do not warrant zero drift. The client reviews transcripts and flags any violations within 7 days; we adjust the prompt or RAG to prevent recurrence.
The 45-day rebuild guarantee (Lead Machine)
Why this clock starts at "fully live" and not at signing: a paid lead system needs real ad data before anyone can judge whether it is working, so we only start counting once the system is actually running. "Fully live" means three things are true at the same time. The Meta ad campaign is out of the learning phase (the learning phase is the early stretch where the ad platform is still gathering data and results swing around). The A2P 10DLC text-messaging registration is approved (A2P 10DLC is the carrier program that lets business texts send legally). The Callback System is live. The clock does not start at signing, and it does not start the day the first ad turns on. It starts the day all three are true.
How the guarantee then works: if, within 45 days of the system being fully live, it is not bringing the client qualified leads, we will rebuild the lead system at no additional cost and keep working on it. This guarantee is a rebuild. We keep working for free. It is not a refund of fees paid, and it is not a payment of money. The specific terms, including how a qualified lead is defined, are set out in the signed service agreement.
The window counts 45 days of qualified ad spend. The 45 days are measured as 45 days during which paid ad spend in the client's ad account holds at or above the $3,000 per month minimum floor. If A2P 10DLC approval is still pending (a carrier-controlled step we do not control), the guarantee clock pauses until approval lands, then resumes. Any period where spend drops below the $3,000 floor does not count toward the 45 days. The qualifying-spend window is also capped at 6 calendar months from the system going fully live; days that do not count toward the 45 days do not extend the window past that ceiling.
What the rebuild covers: refreshing the ad creative (new images, new video, new ad copy), swapping the audience targeting, and tightening the lead-capture copy and follow-up sequence. The rebuild is a focused fix to the live system. It is not a rewrite of the site, the CRM, or the underlying build, because those pieces are working systems and a rewrite is not what a slow lead system needs.
One rebuild per client: the guarantee covers one rebuild per client, ever. The reason is that a paid lead system is a tuning problem, and the data needed to tune it builds up over time. Stacking rebuilds restarts that data clock and would keep the system in permanent re-tuning. After the rebuild, the standard month-to-month service continues, and we keep iterating on the live system as part of the monthly work.
When the guarantee does not apply: if the client does not follow up with leads in a reasonable time (defined as a 10-minute callback during business hours, if for any reason the Callback System is not handling it), or if the client changes the trade, service area, or offer during the 45-day window. Ad spend is handled by the counting rule above, not as a separate disqualifier: any period where spend drops below the $3,000 floor simply does not count toward the 45 days, so the clock pauses rather than the guarantee voiding. These conditions are written into the signed service agreement.
The 45-day rebuild guarantee applies to the Lead Machine only. The Callback System carries no separate rebuild guarantee; its value is set out in the SLA above (5-minute callback attempt, lead capture and SMS, summary writeback, with qualifying, booking, and recording optional and off by default).
CAC baseline gate (required at intake)
Before signing a Bundle agreement, we capture a baseline of the client's existing customer-acquisition-cost (CAC) and cost-per-lead (CPL) over the trailing 90 days, using read-only access to the client's existing Meta and Google ad accounts. If no historical data exists, we document "no baseline established" in the signed service agreement, and performance comparison is forward-looking only, not contractually measurable. This baseline is a hard intake gate. Without it, the contract is not signable.
No income or results guarantee
We do not guarantee any income, revenue, profit, number of leads, number of jobs, conversion rate, or any other business result. Marketing results depend on many things outside our control, including the client's trade, market, pricing, ad budget, and how fast the client follows up with leads.
Any numbers, ranges, or example math shown on this website or in our materials are illustrative examples and our internal estimates, not promises or projections of what any client will earn or receive. A client's actual results will differ.
Limit of our liability
To the maximum extent allowed by law, our total liability for any claim arising out of or related to either product is limited to the fees paid by the client to us in the three months immediately before the event giving rise to the claim. We are not liable for lost profits, lost business opportunity, or consequential or indirect damages. This cap reflects the price of the service. A different cap, or a different allocation of risk, would require a different price.
Use of this website
This website and its content, including the text, design, and the Own The Bid name and mark, belong to Joseph Gomez (Own The Bid). You may read and share the pages. You may not copy the site or its content to pass off as your own.
Governing law
These terms and any service agreement are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be handled in California.
Changes to these terms
If we change this page, we will update the date at the top. The terms that govern an existing client do not change unless that client's signed service agreement is changed in writing.
